The website www.inartebonsai.com belongs to In Arte Bonsai di Bonanno Carmelo (hereinafter referred to as In Arte Bonsai), VAT number 11529180017, Rea IM-200274, Registered office in Località Gray 12, 18033 Camporosso (IM) and its object is the sale of courses, bonsai, and materials related to the practice of the discipline; the promotion of activities organized by In Arte Bonsai; the promotion of events organized by In Arte Bonsai and other entities; the promotion of other commercial entities collaborating with In Arte Bonsai.
The informative pages contain information and descriptions of the activities proposed by In Arte Bonsai; information and descriptions of events promoted by other amatour or professional bonsai entities; information and descriptions of entities collaborating with In Arte Bonsai; information that In Arte Bonsai considers useful for its users. The multimedia catalog contains photos, descriptions, information, and prices of courses, bonsai, and materials related to the practice of bonsai art. Everything that is reported on the site does not intend to be in any way denigrating or offensive towards anyone and any entity: in case such content is found, we ask you to notify us to give us the opportunity to remove it as soon as possible. The site may contain typographical errors or inaccuracies that could allow In Arte Bonsai to withdraw from any commitment in case of evident error. The products described in the catalog are the same ones sent after the purchase: any differences in color are attributable to photographic shots and screen resolutions; any differences in the condition of the plants are attributable to the current season. In Arte Bonsai reserves the right to change these conditions, prices, and items for sale at any time without obligation to give notice.
Each purchase transaction will be governed by the provisions of Legislative Decree no. 206/2005 as amended by Legislative Decree no. 21/2014 and, with regard to privacy protection, will be subject to the regulations of Legislative Decree 30/06/2003 no. 196.
- ACCEPTANCE OF THE GENERAL SALES CONDITIONS AND OBLIGATIONS OF THE CUSTOMER
The customer, by sending the electronic purchase order, unconditionally accepts and undertakes to observe the general conditions and payment terms described below in their relationship with In Arte Bonsai, declaring to have read and accepted all the indications provided to him under the above-mentioned regulations, also acknowledging that In Arte Bonsai is not bound by any conditions other than those previously agreed in writing.
These General Sales Conditions must be examined online by visitors to the website www.inartebonsai.com before they confirm their purchases. The submission of the order confirmation therefore implies full knowledge of the General Sales Conditions and their full acceptance.
Once the online purchase procedure is completed, the Customer undertakes and obliges to print and keep these General Sales Conditions, already viewed and accepted during the purchase process.
- PRICES AND MODES OF PURCHASE
www.inartebonsai.com is an online site that offers the possibility to purchase bonsai and material for the practice of bonsai art.
The purchase of the products, available as illustrated and described online in their respective descriptive and technical sheets, is made by the Customer at the price indicated, to be confirmed at the time of the order, plus shipping costs as described below and on the Payments and Shipping page.
The prices indicated on the website may be changed by In Arte Bonsai at any time and without prior notice.
The prices of the products published from time to time cancel and replace the previous ones and are subject to the actual availability of the products.
Shipping costs are indicated upon completion of the shopping cart, on the Order Submission page; they can also be viewed on the Payments and Shipping page.
All prices on the website www.inartebonsai.com are in Euro and include VAT.
The product images are not binding.
In some cases, the information and descriptions of the products are provided by the manufacturers of the products published on the website www.inartebonsai.com: in this case, In Arte Bonsai is not responsible for any inaccuracies or incompleteness of such information.
Upon completion of the product selection, it will be possible to view the shopping cart, containing the prices of each individual item and the total price of the order. By clicking on "Complete Order," it will be possible to access the order summary page, complete with shipping costs. At this point, after filling in the necessary fields, it will be possible to send the order to In Arte Bonsai.
Following the electronic submission of the order, to complete the process, the Customer will be contacted by the Staff of In Arte Bonsai for the acceptance of the order.
Each order transmitted to In Arte Bonsai constitutes a contractual proposal from the Customer and, therefore, is binding on In Arte Bonsai only if confirmed by it for acceptance. The processing of the order by In Arte Bonsai constitutes confirmation and acceptance of the same.
All purchase orders submitted to In Arte Bonsai must be complete in all their parts. In Arte Bonsai reserves the right not to accept incomplete or improperly filled out orders.
In case of non-fulfillment of the order by In Arte Bonsai, if it is due to unavailability of the products ordered by the Customer, In Arte Bonsai will inform the Customer as soon as possible, refunding any sums already paid for the non-executed supply. In this case, the Customer is not entitled to any compensation or reimbursement of any kind. In Arte Bonsai accepts orders from the Customer within the limits of the quantities of the requested products existing in the warehouse. Therefore, In Arte Bonsai's acceptance of the order form submitted by the Customer is subject to the availability of the products in the warehouse.
- PAYMENT METHODS
Payment for products purchased on the website www.inartebonsai.com, including shipping costs, must be made by the Customer immediately after the order confirmation is sent using the following methods:

Payment by bank transfer: It is possible to make the payment by bank transfer. Payment must be made within 3 working days from the order being sent to In Arte Bonsai, beyond this period the order will be considered null. The account holder, reason and IBAN code necessary to make the bank transfer will be communicated on the order confirmation.
Important: the invoice must be requested before making the payment and, in the case of purchases made by a company, it is necessary to communicate the identification code together with all the personal data.
- DELIVERY METHODS
The products purchased will be delivered by In Arte Bonsai by post or courier to the address indicated by the Customer during the filling in phase, exclusively in the Italian territory, during all working days. The fiscal and travel documents will be included in the package. The invoice must be requested before making the payment and, in the case of purchases made by a company, it is necessary to communicate the identification code together with all the personal data.
The shipping costs are the responsibility of the Customer and may vary depending on the courier used, the weight of the packages and the value of the order. In the event that In Arte Bonsai needs to split the shipment, no additional costs will be charged to the Customer.
The delivery terms indicated by In Arte Bonsai refer to the products in stock and must be understood as non-binding for In Arte Bonsai.
The delivery of the packages to the courier by In Arte Bonsai to start the shipment will take place, approximately and without this entailing any obligation for In Arte Bonsai, within 48 hours of receiving the payment. The shipped products will be delivered within the next 2 working days, except for islands and disadvantaged areas, for which 3 working days are expected if the shipment is by courier. Due to these timeframes, especially in the case of bonsai shipments, In Arte Bonsai will prefer shipments in the first days of the week.
Special delivery conditions and terms must be agreed upon in advance between the Customer and In Arte Bonsai.
In case of absence of the recipient from the place intended for delivery, In Arte Bonsai will not be responsible for damages and additional costs resulting from the delay in retrieval.
The products are shipped in cardboard boxes of various sizes, sealed on the top and bottom with packaging tape. The Customer is required to verify at the time of delivery, the conformity of the product delivered to him in relation to the order placed, as follows: a) the number of packages indicated on the carrier's letter corresponds to the number of packages actually delivered; b) the package is intact, undamaged, not wet and in any case conforms to the characteristics described above. Only after this verification the Customer must sign the delivery note, after which he cannot raise any objection regarding the external characteristics of what he received from the order placed; in the case instead there is no correspondence between the order and the delivery, according to the aforementioned rules, the Customer must not accept the goods and raise the objection directly to the carrier.
- ASSISTANCE AND WARRANTY
Any post-sale assistance request or complaint can be forwarded via email to the email address info@inartebonsai.com.
In Arte Bonsai guarantees only the material integrity of the products at the time of delivery. Any defects must be reported by the Customer to In Arte Bonsai within 2 months from the delivery date, in accordance with the terms of the legal warranty provided by Dlgs 206/2005, except for bonsai which are perishable by nature and for which a complaint can be sent within 2 days from the delivery date. Claims made outside of the above-mentioned terms cannot be considered by In Arte Bonsai. If the deadlines are met, the Customer is entitled to only the replacement of damaged products after their return. The Customer is not entitled to compensation for any damages, even further damages. The shipping costs necessary for the replacement of products are borne by In Arte Bonsai.
In any case, In Arte Bonsai will replace the product only after verifying the reliability of the defects reported by the Customer.
The warranty applies to products that present conformity defects not detectable at the time of purchase, provided that the product is used correctly and with due diligence, namely in compliance with its intended use and with what is provided in the technical documentation. This warranty is not applicable in case of misuse of the product.
The warranty is personal and will therefore only apply to the original purchaser, and is reserved for private customers and not for traders, resellers, etc.
- CANCELLATION OF THE ORDER AND RIGHT OF WITHDRAWAL
The Customer has the right to cancel the order for any reason before the procedures for sending the ordered products have been initiated. To exercise this right, it is essential to notify via email at the email address info@inartebonsai.com. In case payment has already been made, the entire amount paid will be credited back to the Customer.
The Customer may exercise the right of withdrawal, under the terms and limits set forth in the Legislative Decree February 2014 n°21, within 14 days from the receipt of the ordered products. This right applies to all products contained on the In Arte Bonsai website, with the exclusion of "Plants (Bonsai)" products under paragraph 3. c) of Article 5 of Legislative Decree 185/99, as they are goods that, by their nature, may deteriorate or alter rapidly. However, in case of complaints, please contact In Arte Bonsai who will be available for any necessary clarification. In case of "Plants (Bonsai)" products, which by their nature are perishable goods, the term for withdrawal is 2 calendar days from the delivery date.
Also under the aforementioned Legislative Decree 21/2014, it is specified that the right of withdrawal is exclusively reserved for customers who can be defined as "consumers," that is, only for individuals who purchase products for their own use and act for purposes not related to any professional activity that may be carried out, thus excluding merchants, resellers, etc. If the right of withdrawal is exercised, the Customer must provide, at his/her own expense, the return of the product or products intact, not used, and in their original packaging or with the same characteristics, within 14 days from the date of withdrawal (the postal stamp of reshipment will be valid).
In Arte Bonsai will reject any product returned without packaging or with methods different from those described below, as well as products for which the return shipping costs have not been fully paid; or where the procedures and deadlines provided for by Article 57 of Legislative Decree 21/2014 for the communication of the exercise of withdrawal have not been respected; or in the event that the product is not packaged with the original packaging or is not complete with all accessories, instruction manuals, and everything originally included; therefore, packages sent cash on delivery will not be accepted, nor will packages without the Return Authorization Number (NAR) be accepted. The products in question must be accompanied by the relevant tax documents.
In Arte Bonsai guarantees the replacement of any item that is found to be defective, damaged, or shipped in error with its own responsibility. The Customer may return the goods by post, specifying the reasons for the return and the request for replacement. The postal expenses related to the return will be reimbursed according to the current rates applied by Poste Italiane. The deadline for the expiry of the right to return the goods is set at 14 working days following the receipt of the goods.
In case of wrong shipment or damaged product, the shipping costs for the return of the goods and for the new delivery will be borne by In Arte Bonsai. Upon receipt of the goods and after verifying the existence and accuracy of the complaint, In Arte Bonsai will provide for the shipment of the replacement goods. Replacement or refund for wrong shipment will be accepted only if the returned product is in an intact and sealed package, that is, only if the product has not been opened and/or used. To request the return, it is necessary to follow the procedure for exercising the Right of Withdrawal.
- MODES FOR EXERCISING THE RIGHT OF WITHDRAWAL
In accordance with the Legislative Decree 21/2014, the Customer may exercise the right of withdrawal from the purchase contract by sending a written communication by registered letter with return receipt within fourteen solar days from the date of delivery, which explicitly expresses the intention to withdraw from the concluded contract. The aforementioned communication must be sent to: In Arte Bonsai di Bonanno Carmelo, Località Gray 12, 18033 Camporosso (IM) specifying: order code and date; in the case of partial withdrawal, the code and description of the article(s); whether a replacement with a product or products of equal value is desired or whether a refund of the already paid amount is desired.
In Arte Bonsai will communicate to the Customer the Return Authorization Number (NAR) by email. To receive the NAR as soon as possible and accelerate the procedure, the Customer can also make the communication by email or telephone within the same period, provided that it is confirmed by registered letter with return receipt within the following two working days.
After receiving the NAR, the Customer must carefully pack the materials in their original packaging, close it well in order to safeguard the original packaging of the products from any damage, seal the package carefully, applying a label with the address and the Return Authorization Number (NAR) in a clear and visible position. The Customer must send everything back within fourteen solar days from receipt of the goods by post with "Ordinary Postal Parcel" to the following address: In Arte Bonsai di Bonanno Carmelo, c/o Vivaio Noaro, Corso Vittorio Emanuele 151, 18033 Camporosso (IM).
If the above procedure is carried out correctly, In Arte Bonsai will credit the Customer with the amount paid, excluding shipping costs if it concerns a withdrawal, as soon as possible and in any case within 30 days from receipt of the withdrawal communication. In the case of a return, the refund order will include the shipping costs.
